上诉人恒木（中港）有限公司（下称恒木公司）因与被上诉人崔苏中建设工程合同纠纷一案，不服北京市朝阳区人民法院（2007）朝民字第10674号民事判决，向本院提起上诉。本院受理后，依法组成合议庭进行了审理。本案现已审理终结。
本院经审理认为：原判违反法定程序可能影响案件正确判决。依照《中华人民共和国民事诉讼法》第一百五十三条第一款第（四）项之规定，裁定如下：
一、撤销北京市朝阳区人民法院（2007）朝民初字第10674号民事判决。
二、发回北京市朝阳区人民法院重审。
