高层次人才和投资者申请签证和居留许可须知

 

一、人员范围

高层次人才和投资者指下列人员:

1.              省(部)级国家机关邀(聘)请的高级顾问以及执行中央或者地方与外国签署的国家级和省(部)级科技合作项目、重点工程协议、人才交流项目的高科技、高层次管理人员;

2.              对国家及社会等有重大或者突出贡献的人员以及执行政府间无偿援助协议的人员;

3.              国家和省(部)级科研机构、重点高等院校聘用的学术、科研带头人以及有关单位聘用的具有副教授、副研究员以上职称或者享受同等待遇的学术、科研骨干;

4.              在企业、事业单位中担任副总经理以上职务或者享受同等待遇的高级管理人员和重要专业技术人员;

5.              在宁投资300万美元以上的人员以及符合上述条件的外国企业或者其他经济组织派遣来中国的管理人员和专业技术人员;

6.              国际重要科学奖项的外国籍华人获得者和其他杰出、重要外国籍华人;

7.              1项至第6项人员的配偶和不满18周岁的子女。

 

二、居留许可申请

申请居留许可所需材料及期限:

高层次人才和投资者及其随行家属(配偶、未成年子女),持“Z”签证入境,入境后30日之内到南京市公安局出入境管理处申请居留许可。根据需要,可以申请2年以上、5年以内的居留许可,申请次数不限。

申请居留许可时,须回答有关询问并提供下列材料;

1.              本人有效护照及签证的原件和复印件;

2.              临时住宿登记证明;

3.            填写《外国人签证、居留许可申请表》,粘贴一张近期二寸半身正面免冠照片;

4.            高层次人才申请居留许可须提供一类被授权单位公函以及《外国专家证》或者《外国人就业证》等证明文件;投资者申请居留许可须提供外商投资企业批准证书、营业执照等有关证明文件;

5.            江苏省国际旅行卫生保健中心出具的《境外人员体格检查记录验证证明》原件(年满18周岁首次申请1年以上有效期居留许可者提供);

6.            随行家属还需提供任职或者就业单位公函,配偶还需提供婚姻证明,子女还需提供亲属关系证明;

 

三、签证申请

高层次人才申请F签证须提供一类被授权单位公函等证明文件;投资者申请F签证须提供外商投资企业批准证书、营业执照等有关证明文件。根据需要,可以申请有效期2年以上、5年以内的多次入境有效签证,申请次数不限。

 

  四、签证、居留许可补办

持新护照人员申请签证、居留许可,除按申请签证、居留许可须提供的相应材料外,还须提供下列证明;

1.              丢失护照领取新护照者,还须提供公安机关出入境管理部门出具的护照报失证明或者外国驻华使馆、领馆照会;

2.              因护照即将到期或者签证页用完等情况领取新护照者,还须提供本次入境时所持护照;

3.              在中国境内出生的单独持有护照的外籍婴儿,须提供外籍婴儿的出生证明及父母双方的护照复印件。

五、注意事项

1.          居留许可持有人的居留事由、护照号码、偕行人等情况发生变化的,须在10日内向市公安局出入境管理处申请新的居留许可。

2.          居留许可持有人的住址、任职或就业单位等情况发生变化的,须在10日内向市公安局出入境管理处申请变更。

3.              持有居留许可的外国人,可以在居留许可有效期内在华居留,也可以多次出入中国国境。

4.              申请居留许可,可以由工作单位代办。但首次申请居留许可,必须由本人申请。

5.              对在中国非法居(停)留或具有其它违法行为的外国人或责任人,公安机关将依法予以处罚。

6.              外国人申请居留许可,必须按照中国政府主管部门的有关规定缴纳费用。

7.              上述可以申请签证、居留许可的有效期及签证的入境次数,应以公安机关出入境管理部门最终批准的结果为准。

8.              公安机关出入境管理部门有权依法拒发外国人签证、证件,对已发出的签证、证件有权吊销或宣布作废。

9.              受理、审批、签发签证、证件需5个工作日。

Notice to High-level Talents and Investors

Applying for Visas

 

I.  Definition for “high-level talents and investors”

The term of “high-level talents and investors” refers to the following personnel:

1.    Senior advisers invited (or employed) by the state organs at the  provincial (or ministerial) level, and high-tech or high-level managerial staff implementing science and technology joint projects, key project agreements that Chinese central or local government signed with foreign countries;

2.    Those who have made great or prominent contributions to the nation and the society, as well as those who are implementing agreements of inter-government aids without repayment;

3.    Academic or scientific research fellows employed by scientific research institutions or key colleges and universities that are at the national and provincial (ministerial) level, and academic or scientific research fellows who are employed by related units and have at least the professional titles of associate professor or associate research fellow or enjoy the same treatment;

4.    Senior managerial staff and key professional and technical personnel  who hold the post above assistant general manager in business and public institutions or enjoy the same treatment;

5.    Those who invested over $3 million in Nanjing, and those   managerial staff, professional and technical personnel dispatched to China by foreign enterprises or other economic organizations who meet the above-mentioned condition;

6.    Those Chinese who have foreign nationalities and won important international scientific awards, as well as other outstanding and important Chinese with foreign nationalities;

7.    Spouses and children under the age of 18 of those people mentioned in   Item 1 through Item 6 above.

 

I.  Applying for Residence Permit

High-level talents and investors and their accompanying family members (spouses and minor children) are required to enter China with Z-visa. They must come to Nanjing Exit-and-Entry Administration Division of Public Security Bureau to apply for residence permit within 30 days after their entry. They can apply for a residence permit that is valid for over 2 years but not exceeding 5 years, and they may apply as many times as they prefer.

Applicants should answer related questions if asked and provide the following documents:

1.    Applicant’s original and valid passport and Z-visa, as well as copies of the applicant’s passport and visa;

2.    Temporary Residence Registration Certificate;

3.    Properly-completed Foreigner’s Visa and Residence Permit Application Form with a photograph affixed to the form. The photograph should be:

l      Two inches in size

l      taken recently, showing current appearance

l      show full face and front view with a plain white or off-white background

l      taken in normal street attire (do not wear a hat or headgear that obscures the hair or hairline);

4.    High-level talents applying for residence permits are required to provide official letters of authorized units, Foreign Expert Certificates or Foreigner Employment Certificates and other documents. Investors  applying for residence permits should provide approval certificates of foreign investment enterprises, business licenses and other documents;

5.    If you are under the age of 18 and this is the first time for you to apply for a residence permit that is valid for more than 1 year, you should provide the original Certificates of Health Examination Report for Foreigners issued by Healthcare Center of Jiangsu International Travel;

6.    Accompanying family members should provide official letters from their employers. Spouses should provide marriage certificates, and children should provide kinship certificates.

 

II. Applying for Visa

High-level talents applying for F-visa should provide official letters of authorized units and other documents. Investors applying for F-visa   should provide approval certificates of foreign investment enterprises, business licenses and other documents. Applicants can apply for multi-entry visas that are valid for more than 2 years but not exceeding 5 years. They may apply as many times as they prefer.

 

. Re-applying for Visa and Residence Permit

Besides the above-mentioned required documents, applicants holding new passports and re-applying for visa or residence permits should also provide the following documents:

1.    If you hold a new passport because your previous passport was lost, stolen, or damaged, you should provide certificates of passport loss report issued by the departments in charge of administration of exit and entry under the public security organs or provide certificates issued by relevant foreign embassies or consulates in China;

2.    If you hold a new passport because your previous passport was expired or your visa pages had run out, you should provide the previous passport that you used when you entered China;

3.    For foreign infants born in China and holding separate passports, their parents must provide original birth certificates of the infants and copies of the parents’ passports.

 

. PROVISIONS

1.    If there are any changes in the residence permit holder’s reason of residing, passport number, or the number of accompanying people, etc., the residence permit holder must come to Nanjing Exit-and-Entry Administration Division of Public Security Bureau within 10 days to apply for a new residence permit.

2.    If there are any changes in the residence permit holder’s address, employers, etc., the residence permit holder must come to Nanjing Exit-and-Entry Administration Division of Public Security Bureau within 10 days to apply for the changes.

3.    Residence permit holders can reside in China within the valid residence period, they may also enter and exit China as many times as they prefer.

4.    You may ask your employer to apply for residence permit for you. However, if you are applying for the first time, you must apply by yourself.

5.    The public security organs will impose punishment in accordance with law on those foreigners or responsible persons who unlawfully reside or stay in China or break law in China.

6.    Applicants must pay application fee in accordance with the relevant regulations of competent organs of Chinese government.

7.    Applicants’ valid period of visas and residence permits, as well as the total entry times of their visas should be based on the result of approval by the departments in charge of administration of exit an entry under public security organs.

8.    The departments in charge of administration of exit and entry under pubic security organs have the right to refuse to issue visas and documents to foreigners in accordance with law, and to revoke the issued visas and documents or declare null and void.

9.    The normal processing time, including accepting application, examination, approval and issue of visas or documents, is five business days.
